Terms of use
Last updated: 18 October 2026
Gustly is a kite forecast: a wind map, spot forecasts and an AI chat that gives you a call for a spot and a time. It is a project by Dr. Berend Gort (details on the legal notice). By using Gustly you agree to these terms. If you do not agree, please do not use it.
Forecasts can be wrong. You decide.
Kiteboarding is dangerous. It can injure or kill you and the people around you. Gustly helps you think about where and when to go. It does not make that decision for you, and it does not make it safe.
- Weather forecasts are predictions. They come from public weather models through Open-Meteo and are often off: wind can be stronger, weaker, gustier or from another direction than shown, and fronts, squalls and thunderstorms can arrive with little warning.
- The AI chat can be wrong too. It reads the same forecasts and can misread them, mix up places, or state something with more confidence than the data allows.
- SEND IT, GREEN LIGHT and SIT IT OUT are advice, not a guarantee. A SEND IT does not mean it is safe for you, your gear or your level on that day.
- Look before you launch. Always check the real conditions on the beach, the sky, the tide and current, the water and air temperature, other water users, and the local rules, zones and closures. Ask local riders or a school when you do not know a spot.
- You ride at your own risk. You alone decide whether to go out, with which gear, and when to come in.
Your account
- You sign in with Google. You must be at least 16 years old to use Gustly.
- Keep your Google account secure; whatever happens through your signed-in session is on you.
- You can delete your account and everything under it at any time, see delete your account.
Fair use
Gustly runs on a small budget. Please do not:
- scrape it, flood it with automated requests, or try to get around its rate limits;
- try to break into it, another rider's account, or the services behind it;
- use the chat to produce anything unlawful, hateful or harmful;
- resell Gustly or its forecasts as your own service.
Gustly may limit, pause or close an account that breaks these rules or puts the service at risk.
What you put in
Your chats, spots, profile and feedback stay yours. You let Gustly store and process them only to run the service for you, as explained in the privacy policy.
Gustly's own work and the data behind it
The Gustly name, logo and app are Dr. Berend Gort's. Forecast data comes from Open-Meteo under CC BY 4.0, with weather models from national weather services, and the map from OpenStreetMap contributors through OpenFreeMap. Credits are shown on the map.
No warranty
Gustly is provided as it is, without any warranty that it is accurate, complete, available or fit for a purpose. It can be down, slow or wrong at any time.
Liability
As far as Spanish and EU law allow, Dr. Berend Gort is not liable for any loss, injury or damage that comes from using Gustly or relying on its forecasts or advice. Nothing in these terms limits liability that the law does not allow to be limited, such as for intent or gross negligence, or your rights as a consumer under mandatory law.
Changes and ending
Gustly can change, pause or stop at any time, in part or in whole. These terms can change too; the date at the top shows the latest version, and an important change will be shown in the app. You can stop using Gustly at any time.
Law and disputes
These terms fall under Spanish law. If you live in the EU, you keep the protection of the mandatory consumer law of your own country and can go to the courts there.
